Terms of Service

These Terms of Service ("Terms") govern your access to and use of QR North ("the Service"), operated by Masterbyte Network Solutions (MASTERBYTE), Ontario, Canada ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Accounts

  • You must provide a valid email address and complete email verification to activate your account.
  • You are responsible for maintaining the confidentiality of your password and for all activity under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.
  • Unverified accounts are automatically deleted after 7 days.

3. Service Tiers and Quotas

The Service is offered in three tiers — Free, Plus, and Pro — each with defined limits on QR codes, monthly scans, and available features. Current tier limits are described on the Pricing page. We reserve the right to modify tier pricing, limits, and features with reasonable notice. Continued use of the Service after such changes constitutes acceptance.

4. Payments and Refunds

Paid tiers (Plus and Pro) are billed on a recurring subscription basis through our payment processor, Paddle. By subscribing, you authorize recurring charges to your payment method at the then-current rate for your selected tier.

  • Refund window: You may request a full refund within 14 days of your initial subscription purchase or any renewal charge by contacting us at info@qrnorth.ca.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period except within the 14-day refund window.
  • Downgrades: If you downgrade to a lower tier or the Free tier, your paid features remain active until the end of the current billing period.
  • Failed payments: If a payment fails, we will notify you by email. Access to paid features may be suspended until payment is resolved.
  • Price changes: We will provide at least 30 days notice before changing subscription prices. Continued use after the effective date constitutes acceptance of the new pricing.

All payments are processed by Paddle (paddle.com), who acts as the Merchant of Record. Paddle's terms and privacy policy apply to payment processing. For billing disputes, contact us at info@qrnorth.ca.

5. Acceptable Use

You agree not to use the Service to:

  • Generate or distribute QR codes that link to illegal content, malware, phishing pages, or content that violates applicable law
  • Collect personal information from scanners without appropriate notice or consent
  • Harass, deceive, or harm any person
  • Violate any intellectual property rights
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Use the Service in any way that could damage, disable, or impair it
  • Use automated tools to scrape, crawl, or abuse the Service beyond normal use
  • Resell or sublicense access to the Service without our written consent

We reserve the right to remove any QR code or suspend any account that we determine, in our sole discretion, violates these Terms or is otherwise harmful.

6. QR Code Content and Scan Data

You are solely responsible for the content encoded in your QR codes and the destination URLs they point to. By using the Service's scan tracking features, you acknowledge that scan data (including IP address, approximate location, and device information for Plus/Pro tiers) is collected from people who scan your QR codes. You are responsible for ensuring your use of scan tracking data complies with applicable privacy laws, including PIPEDA. Where required by law, you must inform people scanning your codes that their device and location information may be collected. You may disable scan tracking on individual codes at any time from the code detail page.

7. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

The Service, including its design, software, and content, is owned by Masterbyte Network Solutions and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service. You retain ownership of the QR codes and content you create using the Service.

9. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access. The Service is provided on a self-hosted basis and may be subject to maintenance, updates, or outages. We are not liable for any losses resulting from Service unavailability.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that scan analytics will be complete or accurate.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Masterbyte Network Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Masterbyte Network Solutions and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

You may delete your account at any time from the Settings page. If you have an active paid subscription, it will be cancelled at the end of the current billing period before deletion is scheduled. Account deletion initiates a 30-day grace period during which your account is deactivated but not yet permanently removed. After the grace period, your account data, QR codes, and scan records are permanently deleted. We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with the same data deletion outcome.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.

15. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. The date at the top of this page reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.
